Autograph Auctions – Don’t Consign Until You Read the Fine Print
Autograph auctions can be a great way to buy and sell autographs. However, almost every autograph buyer or seller has heard or experienced a nightmare when the process doesn’t go as intended. The autograph consignment agreements drawn up by attorneys experienced in contract law protects the best interest of their clients – the autograph auction companies.
Perhaps you have unusual items or expensive items that allow you leverage in negotiating a consignment agreement that meets your specifications. But here are some of the fine points to consider when consigning your autographs for auction.
- Don’t Give it Away: Unless you are willing to sell an item for less than your cost, specify a net reserve for your consignment. The auctioneer may tell you to that a low reserve stimulates bidding. Low starting prices means that you risk selling your item at a bargain basement price. Some auction companies attempt to avoid low selling prices by having unspecified reserves that are much higher than starting prices. Some bidders consider this to be deceptive, but it is common practice among autograph auction houses.
- Title: If a buyer disputes authenticity of his purchase, you may be held liable for defending the costs of a dispute against the auction company. Imagine reimbursing the auctions company for claims from a buyer you don’t know or did not screen. Some auction companies stipulate that you agree to reimburse the auction company without any time limit. That means that you may be held responsible for reimbursing the auction house for all costs of a return or dispute whenever your consigned item is returned to the auction company.
- Hidden Costs: Many agreements from auction companies specify that you are responsible for expenses related to processing and returns. That means cataloging, photos, return postage for unsold items may be charged to you as the the consignor. Some auction companies will also charge a buy-back fee for each unsold item.
- Timing: Your auction items may be deferred from showing if the auction company considers any consignment to be similar or duplicitous. Your consignments may be returned (at your expense) or not offered at auction for many months.
- Unsold Items: Auction establishments know the value of items that don’t sell for one reason or another at any particular auction. Your consigment agreement may provide an option for them to buy your consigned items at a reduced price. The auction company can then turn around and sell the items at one of their future auctions and pocket all of the profits.
Many autograph auction agreements are not absolute, especially if you have very rare and desirable items for consignment. The time for you to read the fine print and negotiate terms that meet your needs is before you sign on the dotted line.
